How we handle your data and protect your privacy

Whisnap ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Whisnap application (the "Application"). By using the Application, you consent to the data practices described in this policy.

2. Information We Collect

2.1 Account Information

When you create an account, we collect:

  • Email address
  • Name (optional)
  • Encrypted password
  • Subscription and billing information

2.2 Audio and Transcript Data

Local Processing Mode: When local processing mode is enabled, all audio recordings and transcripts are processed and stored exclusively on your device. No audio or transcript data is transmitted to Whisnap servers or third-party service providers.

Cloud Processing Mode: When cloud processing mode is enabled, your audio recordings may be transmitted to third-party AI service providers or processed through Whisnap's infrastructure for transcription and processing.

Important: Whisnap does not permanently store your audio recordings or transcripts on our servers.

2.3 Usage and Analytical Data

Usage tracking is optional and can be disabled in the Application settings. When enabled, we collect limited usage data to maintain and improve the Application:

  • Feature usage statistics
  • Error logs and crash reports
  • Device type and operating system version
  • Application version information

We do not collect precise geolocation data or access your device contacts.

3. How We Use Your Information

We use collected information for the following purposes:

  • To provide, maintain, and improve the Application's transcription and AI processing features
  • To manage your account and process subscription payments
  • To provide customer support and respond to inquiries
  • To send important notifications regarding service updates, security alerts, and account status
  • To analyze usage patterns and improve Application performance
  • To detect, prevent, and address technical issues, fraud, and abuse
  • To comply with legal obligations and enforce our Terms of Service

We do not use your audio or transcript data for marketing purposes. We do not sell, rent, or trade your personal information to third parties.

4. Data Sharing and Third-Party Services

4.1 AI Service Providers

When cloud processing mode is enabled, your audio recordings may be transmitted to third-party AI service providers or processed through Whisnap's infrastructure for transcription and language processing. Third-party providers operate under their respective terms of service and privacy policies. We do not control how third-party providers handle your data during processing. Users concerned about third-party data processing should utilize local processing mode exclusively.

4.2 Authentication Providers

If you authenticate using Google or Apple OAuth services, we receive only your email address, name, and profile picture. We do not receive or store your Google or Apple account password. Authentication is governed by the respective provider's privacy policy and terms of service.

4.3 Payment Processors

Payment processing is handled by third-party payment service providers. We do not directly collect or store complete payment card information. Payment data is processed in accordance with Payment Card Industry Data Security Standard (PCI DSS) requirements and the privacy policies of our payment processors.

5. Data Retention and Deletion

5.1 Local Data

Data processed in local mode remains on your device under your exclusive control. You may delete this data at any time by clearing the Application's storage or uninstalling the Application.

5.2 Cloud Data

Whisnap does not permanently store audio recordings or transcripts from cloud mode on our servers.

5.3 Account Deletion

You may request account deletion at any time through the Application settings or by contacting support@whisnap.com. Upon account deletion, we will delete your personal information and associated data from our servers within thirty (30) days, subject to applicable legal retention requirements. Certain information, including financial transaction records, may be retained as required by law.

5.4 Data Portability

You may request an export of your data by contacting support@whisnap.com. We will provide your data in a commonly used, machine-readable format within thirty (30) days of your request.

6. Your Privacy Rights

6.1 General Data Protection Regulation (GDPR)

If you are located in the European Economic Area, you have the following rights:

  • Right to Access: Request a copy of the personal data we hold about you
  • Right to Rectification: Request correction of inaccurate or incomplete personal data
  • Right to Erasure: Request deletion of your personal data, subject to legal obligations
  • Right to Restriction of Processing: Request limitation on how we process your data
  • Right to Data Portability: Receive your data in a structured, machine-readable format
  • Right to Object: Object to processing of your data for specific purposes
  • Right to Withdraw Consent: Withdraw consent for processing based on consent

6.2 California Consumer Privacy Act (CCPA)

If you are a California resident, you have the following rights:

  • Right to Know: Request disclosure of personal information we collect, use, and disclose
  • Right to Delete: Request deletion of your personal information
  • Right to Opt-Out: Opt-out of the sale of personal information (we do not sell personal information)
  • Right to Non-Discrimination: Exercise privacy rights without discriminatory treatment

6.3 Exercising Your Rights

To exercise any of these rights, please contact us at privacy@whisnap.com. We will respond to your request within thirty (30) days or as otherwise required by applicable law. We may require identity verification before processing your request.

7. Children's Privacy

The Application is not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under 13. If we discover that we have inadvertently collected personal information from a child under 13, we will promptly delete such information from our systems.

If you are a parent or guardian and believe that your child has provided us with personal information, please contact us at privacy@whisnap.com, and we will take appropriate action in compliance with the Children's Online Privacy Protection Act (COPPA).

8. Data Security

We implement commercially reasonable technical and organizational measures to protect your personal data, including:

  • Encryption in Transit: All data transmitted between your device and our servers is encrypted using Transport Layer Security (TLS/SSL) protocols
  • Encryption at Rest: Sensitive data stored on our servers is encrypted using industry-standard encryption algorithms
  • Access Controls: Strict access controls limit internal access to personal data
  • Regular Security Assessments: We conduct periodic security audits and vulnerability assessments

While we strive to protect your personal data, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security of your data.

9. International Data Transfers

Your information may be transferred to and processed in countries other than your country of residence, which may have different data protection laws. When transferring data internationally, we implement appropriate safeguards, including:

  • Standard Contractual Clauses approved by the European Commission
  • Adequacy decisions by relevant data protection authorities
  • Other legally recognized transfer mechanisms as required by applicable law

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable laws. Material changes will be communicated through:

  • Updating the "Last Updated" date at the beginning of this policy
  • Displaying a prominent notice within the Application
  • Sending email notification to your registered email address

Your continued use of the Application following notification of changes constitutes acceptance of the updated Privacy Policy. We encourage you to review this policy periodically.

11. Do Not Track Signals

Some web browsers incorporate a "Do Not Track" feature that signals to websites that users do not wish to have their online activities tracked. The Application does not currently respond to Do Not Track signals or similar mechanisms.

12. California Shine the Light Law

California Civil Code Section 1798.83 permits California residents to request information regarding the disclosure of personal information to third parties for direct marketing purposes. We do not share personal information with third parties for their direct marketing purposes.
